Privacy Policy

This Privacy Policy forms part of, and must be read together with, the Color Space Terms of Service. Capitalized terms not defined in this Privacy Policy have the meanings given in the Terms of Service.

Color Space is committed to protecting Personal Information and complying with applicable data protection laws, including the Protection of Personal Information Act, 2013 (South Africa) ("POPIA"), the EU General Data Protection Regulation ("GDPR"), the UK GDPR, and other applicable international privacy and data protection regulations.

BY ACCESSING OR USING THE PLATFORM, YOU ACKNOWLEDGE AND AGREE TO THE COLLECTION, USE, DISCLOSURE, AND PROCESSING OF PERSONAL INFORMATION AS DESCRIBED IN THIS PRIVACY POLICY.

1. Scope and Application

This Privacy Policy applies to all Users of the Color Space website, applications, APIs, and related services (collectively, the "Platform"). It does not apply to information processed by third parties that are not owned or controlled by Color Space.

  • Complying with applicable legal, regulatory, tax, and accounting obligations;

  • Improving and optimizing Platform functionality and user experience.

Where required by applicable law, Color Space relies on one or more of the following legal bases:

  • Performance of a contract with you;

  • Compliance with a legal obligation;

  • Legitimate interests pursued by Color Space, including platform security, fraud prevention, and business operations;

COLOR SPACE DOES NOT SELL PERSONAL INFORMATION.

Personal Information may be transferred to, stored, and processed in jurisdictions outside your country of residence. Where required by law, Color Space implements appropriate safeguards, including standard contractual clauses or other lawful transfer mechanisms.

Color Space implements commercially reasonable administrative, technical, and organizational measures designed to protect Personal Information. HOWEVER, NO METHOD OF TRANSMISSION OR STORAGE IS COMPLETELY SECURE, AND COLOR SPACE DISCLAIMS ANY GUARANTEE OF ABSOLUTE SECURITY TO THE MAXIMUM EXTENT PERMITTED BY LAW.

11. Your Rights

Subject to applicable law and limitations, you may have the right to:

  • Request access to Personal Information held about you;

  • Request correction or updating of inaccurate information;

  • Request deletion or restriction of Processing;

  • Object to Processing based on legitimate interests;

  • Withdraw consent where Processing is based on consent;

  • Lodge a complaint with a supervisory authority.

Color Space may refuse or limit requests where permitted by law, including where compliance would adversely affect the rights of others or conflict with legal obligations.

12. Children’s Privacy

The Platform is not directed to individuals under the age of 18. Color Space does not knowingly collect Personal Information from minors.

13. Third-Party Services and Links

The Platform may contain links to or integrations with third-party services. Color Space is not responsible for the privacy practices, security, or content of such third parties.

14. Limitation of Liability (Privacy)

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COLOR SPACE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE PROCESSING OF PERSONAL INFORMATION.

15. Changes to This Privacy Policy

Color Space may modify this Privacy Policy at any time. Changes become effective upon posting. Continued use of the Platform constitutes acceptance of the revised Privacy Policy.
