Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and Color Space and govern your access to and use of the Color Space website, mobile applications, APIs, and related services (collectively, the "Platform"). The Platform provides access to stock photographs, illustrations, vectors, videos, and other visual content (collectively, "Content").

BY ACCESSING, REGISTERING FOR, OR USING THE PLATFORM, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, YOU MUST NOT USE THE PLATFORM.

1. Definitions

  • "Color Space", "we", "us", or "our" means the Color Space platform, its legal entity, affiliates, licensors, and service providers.

  • "User", "you", or "your" means any individual or legal entity accessing or using the Platform.

  • "Content" means all photographs, images, illustrations, vectors, videos, animations, audio, metadata, keywords, captions, previews, and derivative works made available through the Platform.

  • "License" means the limited rights granted to you to use Content under these Terms.

  • "Contributor" means any User who uploads or submits Content to the Platform.

2. Eligibility and Account Registration

You must be at least eighteen (18) years old or the age of majority in your jurisdiction, whichever is higher, to use the Platform. By creating an account or using the Platform, you represent and warrant that:

  • You have the legal capacity to enter into these Terms;

  • All information provided is true, accurate, and complete;

  • You will safeguard your login credentials and are solely responsible for all activity conducted through your account.

Color Space reserves the right to suspend, restrict, or terminate any account at any time, with or without notice, for any reason, including suspected violation of these Terms.

3. Platform Use Restrictions

You agree that you shall not, directly or indirectly:

  • Use the Platform or Content in any manner that is unlawful, fraudulent, deceptive, defamatory, obscene, pornographic, hateful, or otherwise objectionable;

  • Infringe or misappropriate any intellectual property, privacy, publicity, or proprietary rights;

  • Use Content as part of a trademark, logo, service mark, or brand identity;

  • Redistribute, resell, sublicense, share, transfer, lease, or make Content available as standalone files or in any manner that allows extraction;

  • Use Content in templates, theme builders, on-demand products, or stock collections;

  • Use Content in connection with artificial intelligence, machine learning, neural networks, facial recognition, biometric analysis, or training datasets;

  • Scrape, crawl, index, reverse engineer, decompile, or otherwise exploit the Platform or Content;

  • Circumvent technical protection measures, download limits, watermarks, or access controls.

4. Single License Grant (Personal and Commercial Use)

Subject to full compliance with these Terms and payment of all applicable fees, Color Space grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use Content for both personal and commercial purposes.

This License permits use of Content solely as incorporated into a larger creative work or end product and strictly prohibits standalone use.

Permitted Uses (Non-Exhaustive)

  • Digital and print media, including websites, social media, advertising, presentations, and publications;

  • Marketing, promotional, and corporate communications;

  • Editorial use, subject to applicable restrictions.

Prohibited Uses (Non-Exhaustive)

You may not:

  • Use Content in a way that suggests endorsement, sponsorship, or association by depicted persons or brands;

  • Use Content in sensitive contexts (including politics, health, crime, or adult content) without express written authorization;

  • Use Content in merchandise, resale products, NFTs, or print-on-demand items;

  • Exceed reasonable reproduction or distribution limits determined by Color Space;

  • Remove copyright notices, metadata, or proprietary markings.

All rights not expressly granted are reserved by Color Space and its licensors.

5. Editorial Content Disclaimer

Content designated as "Editorial Use Only" may be used solely for non-commercial, informational, or newsworthy purposes. Such Content may not be used for advertising, marketing, promotion, or endorsement.

6. Contributor Content and Rights Grant

If you are a Contributor, you represent, warrant, and covenant that:

  • You own or control all necessary rights, licenses, consents, and releases for your Content;

  • Your Content does not infringe or violate any third-party rights;

  • All information submitted is accurate and not misleading.

You grant Color Space a worldwide, perpetual, irrevocable, royalty-free, sublicensable license to host, reproduce, distribute, publicly display, modify, market, and license your Content in any media now known or later developed.

7. Model and Property Releases

Color Space does not guarantee that Content includes all necessary model, property, or trademark releases. You are solely responsible for determining whether releases are required for your intended use and for obtaining any additional permissions.

8. Fees, Payments, and Taxes

All fees are stated exclusive of taxes unless otherwise indicated. You are responsible for all applicable taxes, duties, or levies. Payments are non-refundable except where required by applicable law.

Color Space reserves the right to modify pricing, payment structures, or access models at any time.

9. Intellectual Property Ownership

The Platform, Content, and all associated intellectual property rights are owned by Color Space, Contributors, or licensors. No ownership rights are transferred to you under these Terms.

10. Copyright Infringement and DMCA-Equivalent Notices

Color Space respects intellectual property rights and complies with applicable copyright laws. Notices of infringement must include sufficient detail to identify the allegedly infringing material and a statement made under penalty of perjury.

11. Termination and License Revocation

Color Space may terminate or suspend your access to the Platform or revoke any License immediately, without notice. Upon termination, you must cease all use of Content and delete all copies in your possession or control.

12. Disclaimers

THE PLATFORM AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, COLOR SPACE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COLOR SPACE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES. COLOR SPACE’S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO COLOR SPACE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify, defend, and hold harmless Color Space from any claims, damages, losses, liabilities, costs, and expenses arising out of your use of the Platform, Content, or violation of these Terms.

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa, without regard to conflict-of-law principles. You irrevocably submit to the exclusive jurisdiction of the courts of South Africa.

16. International Use and Compliance

You are responsible for compliance with all applicable local, national, and international laws, including export control, sanctions, and data protection regulations. Access to the Platform may be restricted in certain jurisdictions.

17. Changes to These Terms

Color Space may modify these Terms at any time. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

18. Miscellaneous

  • These Terms constitute the entire agreement between you and Color Space;

  • Failure to enforce any provision does not constitute a waiver;

  • If any provision is held unenforceable, the remaining provisions shall remain in full force and effect;

  • You may not assign these Terms without Color Space’s prior written consent.
